Dear Customer, below are the regulations for our “We Terranova” loyalty programme.
The promoter of the We Terranova loyalty programme, which is activated when the special Fidelity Card is issued, is Teddy S.p.A, with offices in Rimini (RN), via Coriano, 58, tax code no. 00953910403.
2) Beneficiaries of the We Terranova programme and Fidelity Card
The beneficiaries of the We Terranova programme and therefore, the Fidelity Card are all consumers aged 18 or over who shop at Terranova brand stores.
3) What is the Fidelity Card?
The Fidelity Card allows the holder to participate in the We Terranova loyalty programme and more specifically, in all promotional campaigns dedicated to Fidelity Card holders, based on the relevant regulations published each time, both in participating stores and on the www.terranovastyle.com website.
The Fidelity Card is for the named card holder only. Card holders have the right to only one Fidelity Card and must only use it for personal reasons and never for commercial gain.
4) Issuing the Fidelity Card
The Fidelity Card is issued entirely free of charge, following the correct, complete and truthful filling out of the relevant application form, which can be found in all Terranova stores. Alternatively, customers can apply via the We Terranova mobile app or – if and when applicable – via the www.terranovastyle.com website or the special in-store Touch Points.
Failure to fill in the form correctly or providing incomplete and/or untruthful information will imply the impossibility to issue the card or revocation of the same. The card holder also undertakes to notify Teddy S.p.A. of any changes to personal data.
Any personal data provided by the card holder will be processed by Teddy S.p.A. in compliance with the provisions of legislation relating to the protection of personal data (Legislative Decree no. 196/2003 and EU Regulation 679/2016), as specified in the information sheet provided to everyone applying to join the We Terranova loyalty programme at the time of application; it is also added as a footnote to these regulations and should be considered an integral and substantive part of the same.
5) Use of the Fidelity Card
To enjoy the benefits offered by the Fidelity Card, customers must present it and/or the mobile app code before the receipt for products purchased in a Terranova store is issued. Alternatively, for purchases made on the www.terranovastyle.com website, identification details should be input when requested during the purchasing process.
For security reasons, the same Fidelity Card cannot be used for more than five transactions in a single day.
6) Validity and revocation of the loyalty programme and Fidelity Card
The We Terranova loyalty programme, along with the relevant Fidelity Card and mobile app do not expire, but Teddy S.p.A. reserves the right to revoke them at any time and without notice if they are used fraudulently, incorrectly or in a manner that could prove detrimental to Teddy S.p.A., as well as in the event of the use of the above tools in breach of the regulations.
Revocation of the Fidelity Card implies annulment of the card and cancellation of any benefits accumulated and not yet used. Teddy S.p.A. reserves the right to request the restitution of any benefits acquired illegally (points, prizes, discounts, etc.), as well as the right to take legal action against the holder of the revoked card.
7) Loss, damage, theft, malfunctioning, counterfeiting or manipulation of the Fidelity Card
If the Fidelity Card is lost, damaged, stolen or malfunctions the relevant holder must promptly notify Teddy S.p.A. that, after checking the identification of the holder, undertakes to take the necessary steps to cancel and replace the old Fidelity Card with a new one and to credit the latter with any benefits accumulated and not yet used.
Teddy S.p.A. reserves the right to check the validity of any Fidelity Card presented and to refuse any card that has been counterfeited or manipulated in any way.
Teddy S.p.A. is not liable for any fraudulent, improper or unlawful use of the Fidelity Card.
Teddy S.p.A. is not liable for any direct or indirect consequences connected to malfunctioning of the Fidelity Card or the systems for its management for reasons beyond its control. In any case, Teddy S.p.A. undertakes to do everything possible to guarantee holders the restitution of any benefits accumulated and not yet used.
8) Returning the Fidelity Card
The Fidelity Card holder can return his or her card to Teddy S.p.A. at any time.
Returning the card implies waiving the right to any benefits accumulated and not yet used.
9) Changes to regulations
Teddy S.p.A. reserves the right to change the terms and conditions of the We Terranova loyalty programme at any time, in its own irrevocable judgement and without any written notice to Fidelity Card holders. In the event of changes to the terms and conditions of the loyalty programme, the new regulations will be promptly published at participating Terranova stores and on the www.terranovastyle.com website and mobile app. We therefore, kindly invite customers to visit these sites frequently to ensure they are up to date on any changes.
10) Acceptance of regulations
Signing the We Terranova programme application form, as well as participating in the programme via the mobile app or – if and when available – via the www.terranovastyle.com website or in-store Touch Points implies full and unconditional acceptance of all the clauses contained in these regulations which, as well as being available for card holders at Terranova stores, are also published on the www.terranovastyle.com website and can be consulted in the special section of the mobile app.
Pursuant to Art. 13 of Legislative Decree no. 196/2003 (Personal Data Protection Code) and Arts. 7 and 13 of EU Regulation 679/2016 (Regulation), please note that the personal data provided or acquired when joining the We Terranova loyalty programme will be processed in compliance with applicable law and the principles of correctness, lawfulness, transparency and protection of confidentiality provided by the same.
Data processor_ The personal data processor is Teddy S.p.A., with offices in via Coriano, 58, tax code and VAT number
00953910403, that, as part of its prerogatives, can avail itself of the collaboration of specially-selected managers or representatives; an update list of these persons is available to data subjects further to a simple email request being sent to the following address: email@example.com.
Purposes of processing_ Personal data is processed for the following purposes:
a) issuing the Fidelity Card and managing activities that cannot be exercised in anonymous form and necessary in order to allow subscribers to the We Terranova loyalty programme to use the benefits, discounts and promotions offered and participate in collecting points and accessing additional services that can be used via the Fidelity Card;
b) carrying out, following express written consent, direct marking activities such as sending – including via email or text message – advertising material and communications containing information and/or promotions relating to the products or services provided and/or promoted by the data processor or its sales network, including gifts and free samples;
c) carrying out, following express written consent, of individual or aggregate profiling and market research activities with the aim, for example, of analysing consumer habits and choices, processing statistics on the same or assessing the level of satisfaction relating to the products and services offered. Further information on the logics used and the importance and consequences for the data subject are available further to a simple request being sent to the following email address: firstname.lastname@example.org.
Processing means_ Personal data will be processed using electronic and/or manual means, using logics closely linked to the purposes indicated below and adopting procedures and measures designed to guarantee confidentiality and security.
Legal basis_ The data processing herein described is based on both subscription of the data subject to the We Terranova loyalty programme and on the consent provided by the data subject.
Nature of providing data, scope of dissemination and transmission_ For the purposes pursuant to letter a) in the point above, providing data is optional, but constitutes a necessary and indispensable condition for issuing the Fidelity Card: failure to provide it therefore means the applicant cannot obtain the Fidelity Card itself. For the purposes pursuant to letters b) and c) in the point above, providing data is optional and a refusal to provide such data and grant consent means the data controller cannot follow up the direct marketing activities and profiling indicated therein, but does not jeopardise the possibility for the applicant to obtain a Fidelity Card and access all the benefits connected to it. Data will be processed by personnel directly employed by the data controller and/or natural or legal persons specially selected by the same, such as managers and representatives and duly-appointed external managers and their processing representatives. The data provided will not in any case be disseminated or disclosed to third parties, with the exception of persons whose faculty to access data is recognised by law or by order of the authorities, as well as persons, even if external and/or overseas, that Teddy S.p.A. uses to carry out activities that are instrumental and/or additional to management of the Fidelity Card and provision of the services offered and the benefits connected to it, including providers of software, web application and storage service solutions, including those provided via Cloud Computing systems. Please note that, in compliance with applicable legal provisions, sensitive personal data will not be processed unless express written authorisation is provided and – where applicable – following authorisation by the competent authorities. Finally, pursuant to We Terranova loyalty programme regulations, any data collected can be transmitted to servers that may be located in non-EU countries. In the event, Teddy S.p.A. will guarantee that suitable security measures are adopted, pursuant to the provisions of the Regulation. Duration of data processing_ The personal data will be processed for the entire period during which the data subject subscribes to the We Terranova loyalty programme. In the event of revocation of subscription to the above programme, personal data will be stored by the data processor in order to prove fulfilment of its obligations, until the limitation period.
Data protection officer_ Where present, the data subject can obtain details regarding the data protection officer by sending a simple request to the following email address: firstname.lastname@example.org.
Rights of the data subject_ Personal data subjects can, at any time, exercise their rights against the data processor, pursuant to Art. 7 of the Data Protection Code and Arts. 15 and 22 of the Regulation. In particular, they can:
a) access data and obtain confirmation regarding the existence or otherwise of personal data concerning them, even if not yet registered, and its communication in intelligible form;
b) obtain information regarding the origin of the personal data and the purposes and means of processing it; the logic applied in the event of processing carried out using electronic tools; details identifying the data processor, the managers and the representative appointed pursuant to Art. 5, paragraph 2; the subjects or categories of subjects to whom the data may be disclosed or who may become aware of it in their capacity of appointed representatives on the territory of the State, managers or appointed representatives.
c) obtain the updating, correction or integration of the data, as well as the portability of the same.
d) obtain the cancellation, transformation in anonymous form or blocking of data processed, including data which does not need to be stored for the purposes for which it was collected or subsequently processed.
e) obtain confirmation that the above operations were brought to the attention of those to whom the data was disclosed or disseminated, with the exception of when fulfilment should prove impossible or imply the use of means that are manifestly disproportionate to the right being protected.
f) oppose, either in total or in part, for legitimate reasons, the processing of personal data that concerns them, even if pertinent to the purpose of collection and the processing of their personal data for sending publicity material or direct sales information or for carrying out market research or for commercial communications.
The data subject also has the right make a complaint to a supervisory authority, which in Italy is the Garante per la Protezione dei Dati Personali (Italian Data Protection Authority).
Furthermore, the data subject has the right to revoke consent given for the processing of personal data at any time.
